On August 26, 2010, the law firm of Farris, Riley & Pitt, LLP filed a lawsuit against Blackwell’s Way, Inc. in the Circuit Court of Jefferson County, Alabama.
The case is styled Carmen Stoudermire and Jenine Brown v. Blackwell’s Way, Inc., et al., Civil Action Number CV-2010-903098.00. The Plaintiffs are represented by attorney Adam Clayton with the law firm of Farris, Riley & Pitt, LLP.
The lawsuit alleges Blackwell’s Way, Inc. violated the Fair Labor Standards Act (FLSA) by failing to pay employees for all hours worked and by failing to pay employees overtime wages for all hours worked in excess of forty (40) in a work week. The lawsuit also alleges that Blackwell’s Way, Inc. violated Section 215 of the FLSA by engaging in discriminatory conduct in retaliation against its employees for participation in this FLSA action.
The lawsuit asserts that other employees have been subjected to the same illegal and/or wrongful pay practices. Farris, Riley & Pitt seeks certification as a collective action for recovery of wages (and other damages) for the period beginning three years prior to the filing of this lawsuit until the present.
The Jefferson County Circuit Court Clerk issued service of this lawsuit to the Defendants by certified mail on August 26, 2010. Service was not perfected by certified mail, so a special process server perfected service on Defendant Judy Hayman and Blackwell’s Way, Inc. Counsel for the Plaintiffs is now preparing to file a motion for collective action certification.
