Federal Tort Claims Act cases fall under a separate law that’s not Alabama law, it’s federal law. So, those types of cases are usually on behalf of government workers who are injured in a governmental setting. When these types of cases occur, you’re working with, a lot of times, the US Attorney’s Office to resolve a case or to try a case.
So, the laws are substantively different in federal court in that federal system, the Federal Tort Claims Act system, than in Alabama court or Alabama Common Law. So, you need an attorney that knows how to work both. Our firm handles Federal Tort Claims Act cases and, obviously, cases that arise under Alabama Common Law. So, the evaluation of any particular case requires us to apply the proper law to whatever the mechanism of injury and how the accident or incident occurred.
