Medical malpractice claims are governed by something called the “applicable standard of care.” It’s a form of negligence but just slightly different. So, you look at the care level that is a minimum for that particular procedure, for that doctor, and if his acts or her acts fall below that national minimum standard of care, then they can be liable.
