What should I do if my lawyer is encouraging me to settle my case for less than I think it’s worth?

The value of any particular case is based off of a lot of things. It can be based off of what cases similar to your particular case has settled for traditionally. Lawyers will know that
information. Sometimes lawyers suggest to clients that they take a certain amount of money to settle their case. A lot of times the client may not think that that’s enough money, so it’s important that the attorney and the client sit down and the attorney explains to the client very clearly why your case is within this particular dollar range to settle. If your attorney can’t explain why he or she made the suggestion that they did regarding the value of your case, then you may want to consider getting a second opinion and that’s perfectly natural. You can talk with your attorney about getting a second opinion, or you can just seek out a second opinion, and there’s nothing wrong with that.

How Much is My Case Worth?

This is an extremely difficult question to answer. The value of a case is based on a wide range of criteria including:

The extent of your injuries
Your inability to work / loss of earnings capacity
Your age
Past medical bills
Future medical bills
Pain and Suffering
Whether injuries are temporary or permanent

How Do I Know if I Have a Case?

To have a personal injury case, you must have suffered an injury, and that injury had to be at least partially the fault of another. The injury can be physical or non-physical depending upon the case and the basis of the lawsuit. Invasion of privacy, assault, infliction of emotional distress or an attack on your reputation are examples of injuries that are non-physical.
