A lot of times when we are trying medical negligence cases, the juries don’t get to hear that a particular position or someone associated with the person’s healthcare has a history of prior similar instance. Because of the Alabama Medical Liability Act, we as lawyers can’t even present that to the juries, so they’re left wondering whether or not this physician or this health care provider has had problems similar to this in the past. We wish that we could give that information to the jury, but we simply can’t under Alabama law.
