Why isn’t the accident report admissible in court?

One of the common questions that we get from juries during trial or after trial is, “Why can’t we see the accident report?”

They always want to see the accident report, which is natural. When there is a wreck, there is always an accident report. The problem with that is under Alabama law it is called hearsay. It is a document that is called hearsay. So, it’s not admissible. So, we as attorneys can’t bring up the fact that we can’t show you what we believe is a very important piece of information, and so juries sometimes get confused, or they think that we are trying to hide something simply because we can’t enter the accident report into evidence.
